 Voluntary Surrender of a property

Hi, Im new to this site and was after some advice.

I have just received a letter from the Northern Rock asking me to ring them.

Brief history- When me and my ex split up I stayed in the house to begin with when I was working as I could afford to pay the mortgage, when I left work to get married and move to germany he started paying the mortgage but didnt live there (he rented it out to his nephew) Before I moved I put the house on the market with just my signature, its still on the market to this day but he wont let anyone view it, he has tried to take it off the market but seeing as I signed the papers only i can take it off the market.

I told him he could have the house if he could get my name taken off the mortgage, he tried once in the beginning and got turned down as they said he didnt earn enough.

So for 3 years this is how its been, we both own the house, are both on the mortgage but he has been paying it (or rather he has been getting the money from his nephew to pay it)

I have no direct contact with him as it was a very controlling abusive relationship and we are waiting to go to court again with regard to our Son.

I received a letter today from the NR asking me to ring them in the next 48 hours form the collections department.

I rang straight away and he has not paid Febs mortgage payment and no doubt will not pay this months and he has been in touch with them about doing a voluntary surrender of the property. The lady who is dealing with the case is not in so I spoke to someone else and she was very helpful and she said she understood this must be a big shock for me as this is the first Ive known about it. Im waiting for the lady ringing me back tomorrow to get more info. The house will show as a repossession on any future credit checks I have done and if there is a short fall from the sale we will both be liable to pay it.

Im so annoyed as I wanted to sell the house from the start and he wanted to keep a hold of it as an extra tie to me. We could have had the house sold by now and maybe made a little money from it, but no he has to try and be clever!

In a way its a sort of relief as its all coming to ahead and I will be free of him with regards to the house and he has already had one house repossessed.

I was just after any advice at all about my situation as I dont know anything about it.

Someone please help me!

Hello Jeanzibabs and welcome to the forum.

I'm sorry to hear that you are having such a hard time with this.

On a practical level I'm wondering whether your ex might now work with you on a private sale (rather than a reposession)?

Selling it yourselves you are likely to realise a higher value than if the mortgage lender disposes of the property (possibly in an auction).

This would be in both of your interests and Northern Rock may well support this course of action.

If talking to him is difficult do you have a lawyer who could handle this for you?
