First of all I want to say thanks to Kelly from the site for all her support and help to proceed with the bankruptcy that was straight forward.

The only trouble is mine wasn't a straight forward bankruptcy:

split up from the ex (known to many as satan/adolf hitler-his birthday was the same day as his, hitler that is)

owned 2 properties, i moved into a rented one to escape him, he was on both mortgages

one was rented out to his niece and he lived in our home on his own then

he did everything he could to cripple me financially as he promised if i left him including stopping his niece pay me rent so that mortgage went into arrears and then moving her out. and not letting me rent it to anyone else, it was a buy to let property. In arrears ??2k I paid the mortgage on this in full up until Xmas even though we split up the June prior to that.

I tried to get him to take over the mortgage on our home the Build Soc wouldn't and he kept lying to solicitors saying they would and they wouldn't let him transfer the equity.

He now hasn't paid the mortgage on that property either since feb and he is now in arrears of ??6.5k

I went bankrupt on 23rd Feb, there is negative equity in our home (40-50k)and a little equity (5-10k) in the buy to let and I have ??15k worth of credit card debt and a car worth ??5.2k paid for. They want my car I am still waiting for them to decide.

He is still living in the property and not paying anything???

I had an accident on Jan 3rd also, and it put me in a wheelchair for 2 mths and I am on stat. sick pay with 2 boys still at home. I get some benefits but not much. I have to have surgery in June on my leg and will be off for another 3-4 mths and that is if the surgery is successful. Work are coming out to my home to interview me a week on Thurs why I should have to go through all this when they are only paying me ??75 ssp a week out of my NI contributions I don't know. I feel I should leave as I won't have a car soon either so even when I do get better I won't have a car to travel the 54 miles a day for work, if I used public transport it would take me 4 hrs a day and cost double. Also, with the economic climate they dropped everyone's wages by 10 % which is the travel money easily, but with no car I cannot get to work in 3-4 mths time.

A dilemna and i feel in total limbo, also due to the violence, the split up, the threats from my ex and the continual bombardment to ruin me I have been on anti depressants for a year and 4 mths now, been back and fore to the docs with anxiety and depression. And I never want to work in finance again for the rest of my life which is my job, after everything i have just written about.

He has gone quiet since i went bankrupt as i think he either wanted this or realises how much trouble he is in also now that this has happened. I am finally having peace from him as now he has to deal with the Official receivers and not me. Thank god I didn't marry him!

So if anyone has been through anything like this I will be posting when anything happens in the future.

Oh and now my case is handed to a Private Insolvency firm for them to realise my assets. Watch this space..........life's a joke!!

I am so sorry to hear about all the problems you have had wildthing. He certainly does not sound like a nice man at all and I agree that you are well rid!

I'm sorry about your health problems as well, and I hope this operation sorts you out.

Things can only get better.

Know where you are coming from with the comfort eating as well...........

IVA completed with a full and final offer.

thanks agent smith..trying not to eat today, overeat that is...just got to remember things couldn't possibly get any worse, the only way is up!

Letters off the build. soc. today, trying to get me to sign deed of acknowledgement for the arrears and shortfalls. They are going to repossess the buy to let and are threatening to re-possess the one he is still in. asking me to clear arrears i don't think so.....not signing anything sent them to the receivers.

Hi wildthing - despite everything you're going through and have gone through, you sound a strong person. You know you will survive and come out the other end.

Maybe now is it a time to think of a career change? Not easy I know but not imposible either.

I hope you get to keep your car and I hope your ex leaves you alone and gets whats coming to him.

that is next on the agenda once i get fit and well definitely, but at 46 I'm not sure what yet....but i have plenty of other skills.

So get the op and rehab over with (8 mths approx) and by that time my bankruptcy will be hopefully discharged or close to being discharged and then I can really focus.

I think he's moved out. Had a letter off building society he has requested voluntary reposession on this property too, and they have told him to find somewhere to live, they told me too, but I moved out 9 mths ago. He's the one been living there. Do I let them know his work address incase he is not answering their letters, he is a teacher, yes a teacher teaching our kids, but I bet he hasn't given a forwarding address, thinks he rules the world!

There is no harm in giving his work address to the mortgage company - but do make it clear to them that it is a work address and needs treating with caution. After all why should you deal with all the adverse mail?

What do you think he will do when they finally catch up with him for any shortfall?

Do you think he will go bankrupt himself, I know he really wouldn't want to.....as I understand Melanie he will be liable for all shortfall and arrears unless he does go bankrupt and they can chase him for up to 12 yrs unless he pays up.....I didnt know until after I went bankrupt about this.

Well today my housing benefit 3 mths worth was paid into my frozen account, I have cried and died for about the last 2 hrs.....have to go in and see the bank mgr tomorrow...lost 2 homes already and now not on good footing with landlady with this going on...visiting bank mgr tomorrow at 10 apparently she will give me the cash as I am lead to understand they cannot keep hold of benefit money, the account was frozen and it is against the law to hold onto benefit money????

So does anyone know anything about this....both houses are seemingly now empty....one has a little equity and the other a shortfall and both in arrears. What will the insolvency prac. do....make them sell the one with equity and this one will def. sell quicker and def. sell I think, and realise the asset and then the shortfall on the other what happens, when the Build. soc. sell it the shortfall will go into my BR and he becomes responsible for it? Or does the Build Soc hold onto my BI in the one that has equity and use it to cover the shortfall on the other? Or can the Trustee make them give the equity up towards my BR as he is not interested in the other one with no equity?

the latest......got money back off LLoyds every penny and paid rent. Then walked 50 metre down the street and the mobile went, they are now coming to take my car, sell it and give me ??1000 when they have sold it for another one. It is worth 5 k and I bought it outright it's my little baby bright yellow car....my sunshine car..

devistated, cried, hyperventilated, had the runs......now at home licking my wounds.

Life sucks but one step closer to getting out of hell.....

Hi Wildthing,

Just catching up with the latest posts, and read yours - oh my heart goes out to you - you have had a real rough time. If it is any consolation, I have been through bankruptcy myself and so I can relate to a lot of what you are saying.

As far as the mortgage shortfall is concerned, as long as you told the OR that you were party to the mortgage and this went into your bankruptcy, my understanding (one of the Melanies will clarify) is that you are protected of any shortfall from the sale of the house. The lenders therefore will go after your ex.

I am so sorry about your car, I know it sounds totally ridiculous, but after everything I went through, having nearly lost my home and business, it was Mel G telling me I would lose my car that reduced me to tears!!! I know how you feel, but at least you have been able to sort out your money with LTSB and pay your rent. One less worry.
